Avec l\u2019hiver qui approche, les\u00a0<em>snowbirds<\/em>\u00a0font face \u00e0 un s\u00e9rieux dilemme.<\/h3>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">\u00c9videmment, le gouvernement du Canada recommande d\u2019\u00e9viter tout voyage non essentiel \u00e0 l\u2019\u00e9tranger. Et les Canadiens qui sortent du pays doivent s\u2019astreindre \u00e0 une quarantaine de 14\u00a0jours \u00e0 leur retour.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">La fermeture de la fronti\u00e8re terrestre, au moins jusqu\u2019au 21\u00a0novembre, freine aussi les\u00a0<em>snowbirds<\/em>. Mais pas tous. \u00ab\u00a0Environ 70\u00a0% de nos membres se rendent aux \u00c9tats-Unis en auto. \u00c0 la place, certains ont d\u00e9cid\u00e9 de prendre l\u2019avion et de faire livrer leur voiture aux \u00c9tats-Unis\u00a0\u00bb, rapporte Evan Rachkovsky, porte-parole de l\u2019Association canadienne des snowbirds.<\/p>\n<p>Depuis octobre, les amateurs de soleil sont encourag\u00e9s par l\u2019assouplissement des r\u00e8gles de certains assureurs, comme Desjardins, SSQ et La Capitale. D\u00e9sormais, leur couverture s\u2019appliquera m\u00eame si le gouvernement recommande d\u2019\u00e9viter \u00ab\u00a0tout voyage non essentiel\u00a0\u00bb. Seules les croisi\u00e8res ne sont pas couvertes puisque le gouvernement recommande d\u2019\u00e9viter \u00ab\u00a0tout voyage\u00a0\u00bb de ce type, soit le niveau d\u2019alerte maximal.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">De leur c\u00f4t\u00e9, les transporteurs a\u00e9riens, comme Air Canada, Air Transat et WestJet, ont aussi lanc\u00e9 une assurance qui couvre gratuitement la COVID-19 \u00e0 l\u2019\u00e9tranger \u00e0 l\u2019achat de billets d\u2019avion aller-retour. Mais attention\u00a0: les voyages de plus de 21\u00a0jours ne sont pas couverts.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Malgr\u00e9 tout, \u00ab\u00a0je crois qu\u2019il y aura moins que 30\u00a0% des\u00a0<em>snowbirds<\/em>\u00a0canadiens qui voyageront aux \u00c9tats-Unis cet hiver\u00a0\u00bb, estime M.\u00a0Rachkovsky. Normalement, environ 1\u00a0million de Canadiens de plus de 55\u00a0ans passent plus d\u2019un mois aux \u00c9tats-Unis en hiver, dont environ 250\u00a0000\u00a0Qu\u00e9b\u00e9cois.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Ceux qui poss\u00e8dent une maison l\u00e0-bas font face \u00e0 un autre questionnement. Vendre\u00a0? Louer\u00a0? Refinancer\u00a0?<\/p>\n<h2 class=\"textModule textModule--type-subhead hasFeaturedAuthor\">Vendre<\/h2>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Les propri\u00e9taires qui doivent payer toutes sortes de frais (taxes, assurances, frais de condo, entretien) pour une maison dont ils ne profitent pas peuvent \u00eatre tent\u00e9s de s\u2019en d\u00e9partir.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Le march\u00e9 est propice \u00e0 la vente, \u00e0 cause du manque criant de stocks. Et les Canadiens qui ont achet\u00e9 dans le creux du march\u00e9, il y a 10\u00a0ans, ont fait 125\u00a0% de gain en consid\u00e9rant la devise.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Mais la vente am\u00e8ne son lot de co\u00fbts\u00a0: frais de courtage immobilier (5-6\u00a0%), droits de mutation payables par le vendeur (0,7\u00a0% du prix de vente), honoraires\u2026 sans oublier la facture fiscale.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Pour s\u2019assurer que les \u00e9trangers ne se sauvent pas sans payer leur d\u00fb, le gouvernement am\u00e9ricain applique une retenue de 15\u00a0% sur le produit de la vente.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Mais si l\u2019acheteur de votre maison a l\u2019intention de l\u2019habiter au cours des deux prochaines ann\u00e9es, la retenue sera r\u00e9duite \u00e0 10\u00a0% sur une maison de moins de 1\u00a0million US et elle sera \u00e9limin\u00e9e sur une maison de moins de 300\u00a0000\u00a0$\u202fUS.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Si vous estimez que votre facture fiscale sera inf\u00e9rieure \u00e0 la retenue, il est possible de demander une r\u00e9duction de la retenue. \u00ab\u00a0Mais la proc\u00e9dure peut prendre de 90 \u00e0 150\u00a0jours et entra\u00eener des frais de dossier de 1000 \u00e0 5000\u00a0$\u202fUS, avec un risque de rejet de l\u2019Internal Revenue Service\u00a0\u00bb, indique Shlomi Steve Levy, associ\u00e9 du cabinet de planification fiscale et successorale transfrontali\u00e8re Levy Salis.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Autrement, vous r\u00e9cup\u00e9rerez la retenue vers\u00e9e en trop seulement apr\u00e8s avoir rempli votre d\u00e9claration de revenus am\u00e9ricaine au plus tard le 15\u00a0juin. Dans la plupart des cas, l\u2019imp\u00f4t final repr\u00e9sentera 15\u00a0% du gain en capital, soit l\u2019\u00e9cart entre le prix d\u2019achat et le prix de vente.<\/p>\n<p class=\"epigraph textModule textModule--type-epigraph hasFeaturedAuthor\">Vous devrez aussi rapporter votre gain dans votre d\u00e9claration de revenus canadienne, en n\u2019oubliant pas le gain de change. Mais l\u2019imp\u00f4t pay\u00e9 aux \u00c9tats-Unis permettra d\u2019obtenir un cr\u00e9dit qui r\u00e9duira d\u2019autant votre facture au Canada.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">De cette mani\u00e8re, vous ne payerez pas l\u2019imp\u00f4t en double.<\/p>\n<h2 class=\"textModule textModule--type-subhead hasFeaturedAuthor\">Louer<\/h2>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Sinon, le propri\u00e9taire peut aussi choisir de louer sa r\u00e9sidence.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">\u00ab\u00a0Ceux qui vivent en copropri\u00e9t\u00e9 doivent d\u2019abord s\u2019assurer qu\u2019ils ont le droit. Souvent, la location \u00e0 court terme, de style Airbnb, est interdite\u00a0\u00bb, pr\u00e9vient M.\u00a0Rachkovsky.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Dans un pays qui est rapide sur les litiges, il est crucial d\u2019avoir une assurance responsabilit\u00e9 appropri\u00e9e. V\u00e9rifiez si votre assureur au Canada peut vous offrir une couverture parapluie qui vous prot\u00e8ge partout dans le monde pour plusieurs millions de dollars, sugg\u00e8re M.\u00a0Levy.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">C\u00f4t\u00e9 fiscal, vous devrez percevoir la taxe de vente (6\u00a0% en Floride plus 1\u00a0% dans certaines r\u00e9gions).<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">De plus, il faudra d\u00e9clarer vos revenus de location des deux c\u00f4t\u00e9s de la fronti\u00e8re. \u00ab\u00a0Compte tenu des exemptions personnelles, il est fort possible qu\u2019un non-r\u00e9sidant qui n\u2019a que de petits revenus de location aux \u00c9tats-Unis n\u2019ait pas ou peu d\u2019imp\u00f4t \u00e0 payer l\u00e0-bas\u00a0\u00bb, avance M.\u00a0Levy.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Mais votre locataire devra retenir 30\u00a0% du prix du loyer qu\u2019il enverra au fisc am\u00e9ricain\u2026 \u00e0 moins que vous remplissiez un formulaire pour \u00e9viter cette retenue.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Au Canada, il ne faut surtout pas oublier de remplir un formulaire\u00a0T1135. Cela est obligatoire pour tous les Canadiens qui ont des biens de plus de 100\u00a0000\u00a0$ \u00e0 l\u2019\u00e9tranger, \u00e0 l\u2019exception des biens \u00e0 usage personnel, comme une r\u00e9sidence en Floride\u2026 \u00e0 moins que cette r\u00e9sidence soit lou\u00e9e une bonne partie de l\u2019ann\u00e9e. Gare \u00e0 ceux qui oublient le formulaire\u00a0T1135\u00a0: la p\u00e9nalit\u00e9 est de 2500\u00a0$ par ann\u00e9e.<\/p>\n<p class=\"epigraph textModule textModule--type-epigraph hasFeaturedAuthor\">Ah oui, un dernier d\u00e9tail. L\u2019amortissement obligatoire aux \u00c9tats-Unis lors de la location peut vous causer des tracas au moment de calculer l\u2019imp\u00f4t sur le gain en capital \u00e0 la revente.<\/p>\n<h2 class=\"textModule textModule--type-subhead hasFeaturedAuthor\">Refinancer<\/h2>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">Si les deux premi\u00e8res options vous rebutent, M.\u00a0Levy sugg\u00e8re de refinancer votre hypoth\u00e8que, ce qui permet de rapatrier une partie des gains au Qu\u00e9bec en profitant du taux de change.<\/p>\n<p class=\"paragraph textModule textModule--type-paragraph hasFeaturedAuthor\">En r\u00e9investissant l\u2019argent, les int\u00e9r\u00eats sur le pr\u00eat seront d\u00e9ductibles et le placement rapportera peut-\u00eatre 3 ou 4\u00a0%, avec un peu de chance. \u00c9videmment, ce n\u2019est pas garanti.
